Wild Paths Ltd Terms and Conditions

1. Definitions

  • “Holiday”: Any safari, adventure, or travel-related event provided by us.
  • “Holiday Services”: The provision of services offered by Wild Paths Ltd, including travel arrangements, accommodations, and activities.
  • “Regulations”: Refers to The Package Travel and Linked Travel Arrangement Regulations 2018.
  • “We”, “Our”, “Us”: Refers to Wild Paths Ltd.
  • “You”, “Your”: Refers to the individual making the booking or on whose behalf a booking is made.

2. The Contract Between Us

Your contract is with Wild Paths Ltd, a company registered in the United Kingdom. This contract comes into existence once we issue a confirmation invoice. By making a booking, you agree to pay for the travel arrangements, and we agree to provide the services detailed in the confirmed itinerary. If we are unable to confirm your booking, we will return your payment promptly.

3. Your Authority to Book for Others

If you are booking on behalf of others, you guarantee that you have the authority to accept these terms on behalf of each member of your party. You agree that you and the members of your party are jointly and severally liable for payment and compliance with these terms.

4. What is Included in the Price

  • Accommodation as outlined in the itinerary.
  • Transportation to and from the safari destination, as detailed in the itinerary.
  • Meals and activities as specified in the itinerary.
  • Flight arrangements as stated, if applicable.

5. What is Not Included

  • Travel insurance (which is mandatory for all clients).
  • Personal expenses such as passport and visa fees, vaccinations, and medication.
  • Food, drinks, and services not mentioned in the itinerary.
  • Gratuities not explicitly included.

6. Booking and Payment

A non-refundable deposit of 20% of the total cost is required upon booking. Full payment is due no later than 10 weeks before departure. If you book within 10 weeks of departure, the full cost is payable at the time of booking. Failure to pay the balance on time may result in cancellation of your booking and retention of your deposit.

7. Special Requests

Any special requests must be made at the time of booking. While we endeavor to meet reasonable requests, we cannot guarantee them. Confirmation of a request in writing from us does not constitute a guarantee.

8. Changes to Your Booking

If you need to make changes to your booking, contact us immediately. We will do our best to accommodate changes, but cannot guarantee availability. An administration charge of £75 plus any additional costs incurred will apply.

9. Transferring Your Booking

If you wish to transfer your booking to another person, you must notify us in writing at least 14 days before departure. An administration charge of £100 will apply for transfers made more than 30 days before departure, increasing to £200 if within 14 days.

10. Cancellation by You

If you need to cancel your booking, you must notify us in writing. Cancellation fees will apply as follows:

  • More than 70 days before departure: Loss of deposit
  • 69–56 days before departure: 30% of the total cost
  • 55–42 days before departure: 40% of the total cost
  • 41–28 days before departure: 60% of the total cost
  • 27–7 days before departure: 90% of the total cost
  • Within 7 days of departure: 100% of the total cost

No refunds will be made for services not utilised.

11. Changes and Cancellations by Us

Wild Paths Ltd reserves the right to make minor changes to your itinerary. We will inform you as soon as possible if any significant changes are necessary. If we cancel your Holiday, you may choose to:

  • Accept a full refund;
  • Accept an alternative arrangement of comparable standard;
  • Accept an alternative of lower quality with a price reduction.

We will not compensate for minor changes, such as changes to flight times or routes.

12. Your Financial Protection

ATOL Protection: Wild Paths Ltd (ATOL number 12757) provides financial protection for flight-inclusive holidays. When you purchase an ATOL-protected flight or Holiday, you will receive an ATOL Certificate detailing what is financially protected. In the event of insolvency, the Trustees of the Air Travel Trust may make a payment to you under the ATOL scheme. You agree to assign any such claims to those Trustees.

PTS Trust Account: Payments for your Holiday are held in a trust account managed by Protected Trust Services (PTS). This ensures that your funds are safeguarded until your Holiday is completed.

13. Insurance

It is a condition of booking that you and all members of your party have comprehensive travel insurance. This must cover personal accident, death, medical and repatriation expenses, and cancellation. Wild Paths Ltd does not provide insurance coverage.

14. Passport, Visa, and Immigration Requirements

You are responsible for obtaining all necessary travel documents, including passports, visas, and vaccinations. We accept no liability for any delay or expense incurred as a result of improper or incomplete travel documentation.

15. Health and Fitness

Certain itineraries may involve strenuous activities. You must be in good health to participate. We recommend that you consult your doctor for advice on necessary vaccinations and precautions. You must inform us of any pre-existing medical conditions before booking.

16. Complaints

If you have a problem during your Holiday, you must report it to the relevant supplier (e.g., hotel or guide) and our representative immediately to give us an opportunity to resolve the issue. Failure to notify us at the time may affect your rights under this contract. If the issue is not resolved locally, you must contact us within 14 days of your return.

17. Liability

Wild Paths Ltd accepts responsibility for ensuring that the Holiday arrangements you book with us are supplied as described and that the services offered reach a reasonable standard. However, we are not liable for:

  • Events outside our control, such as force majeure.
  • Loss, damage, or theft of personal belongings.
  • Any changes or cancellations made by third-party suppliers.

18. Data Protection

We take the privacy of your data seriously. Your personal data will be handled in accordance with the Data Protection Act 2018 and used solely for the purpose of fulfilling your Holiday arrangements. For full details, please refer to our Privacy Policy.

19. Jurisdiction

This contract and any disputes arising from it are governed by the laws of England and Wales. Any legal action relating to this contract must be brought in the courts of England and Wales.
